ACCEPTABLE USE POLICY
SnapLoader enables companies and brands to connect users to the companies’ or brands’ promotional materials by the users using the SnapLoader app on smartphones or other compatible devices. Users photograph images in magazines or other publications, on products or television screens, that are identified by the SnapLoader logo, and select from a range of links that connect the user to the company’s or brand’s content-rich websites, videos, apps or other data sources.
These companies and brands use the SnapLoader Platform to store and manage their promotional materials, the publishers and other media through which the companies’ and brands’ promotional materials are accessed, the links, the content that is connected to the links and the user experience. The SnapLoader Platform is hosted on the Hosted Environment.
The primary purpose of this Acceptable Use Policy is to ensure the intended, efficient, lawful and ethical use of the SnapLoader Platform, the Hosted Environment and any Linked Content for the benefit of all SnapLoader’s customers, their clients and suppliers. It sets out the things that you can and cannot do with the SnapLoader Platform, Hosted Environment and the Linked Content.
As the SnapLoader Platform is designed to enable users to connect content through the use of links to a wide range of information sources, (Linked Content), you must ensure that the Linked Content that you provide links to also comply with the terms in this Acceptable Use Policy.
This Acceptable Use Policy applies to all users of the SnapLoader Platform. It is incorporated into the terms and conditions under which the SnapLoader Platform is provided, and may be changed by SnapLoader in its discretion from time to time. Any changed version of this Acceptable Use Policy applies from the date that is 30 days after the date that it was posted to the website.
Where you have a signed agreement with Snaploader for the use of the SnapLoader Platform this Acceptable Use Policy is incorporated into the terms and conditions of your agreement with SnapLoader. If have not signed an agreement with Snaploader for using the SnapLoader Platform this Acceptable Use Policy applies when you use the SnapLoader Platform, and if you do not agree with it you must not use the SnapLoader Platform.
THINGS YOU MUST DO
a) use the SnapLoader Platform only for the purposes for which we designed it to be used;
b) use the SnapLoader Platform strictly in accordance with any instructions made available by SnapLoader, including any user documentation or instructions provided via the helpdesk or during any training session provided by SnapLoader;
c) use the SnapLoader Platform in compliance with any law of Australia or other country;
d) use the SnapLoader Platform in a manner that does not interfere with or harm other users of the SnapLoader Platform or other users of the Hosted Environment;
e) use every effort to use up to date anti-virus software on any device that connects to the SnapLoader Platform;
f) comply with any instruction from SnapLoader to delete or remove any material that, in the opinion of SnapLoader:
a. Contravenes this Acceptable Use Policy.
b. is the result of any lawful instruction from SnapLoader to remove content, for example where a third party has issued a Take Down Notice under the provisions of the Copyright Act 1968 (Cth).
g) Comply with any request from SnapLoader to assist in preventing any breach of this Acceptable Use Policy, or in respect of any legal action that is taken in respect of the SnapLoader Platform, the content or the website. SnapLoader will reimburse any out of pocket expenses where you provide such assistance, and the cause of the breach or the initiator of the legal action is not you, and SnapLoader agrees to reimburse those expenses in writing in advance.
CONTENT THAT YOU MUST NOT USE
You must not use the SnapLoader Platform to, and you must ensure that no link connects to any Linked Content that is, in our opinion, used to, store, display, market, promote or sell any of the following material or data:
a) material including images, that embodies the intellectual property rights (including trade mark, registered, unregistered and common law and copyright, including a creators moral rights) of a third party such as but not limited to authors, artists, photographers or others, without the express written consent of the owner of such rights, or in any way infringe the intellectual property rights or moral rights of any third party;
b) personal data or sensitive personal data in breach of the terms of any privacy laws or confidential information in breach of confidence;
c) material that breaches any code of conduct, whether voluntary or otherwise, including any advertising code of conduct;
d) material that is false, misleading or deceptive or is likely to mislead or deceive;
e) material that unlawfully exploits persons under 18 years of age;
f) material that is grossly offensive, including expressions of bigotry, prejudice, racism, hatred or profanity or includes any obscene, lewd, lascivious, violent, harassing or otherwise objectionable content;
g) material that advocates, promotes or otherwise encourages violence against any governments, organisations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence;
h) material that could be, or is, rated R, RC or X by the Classification Board of the Australian Broadcasting Authority;
i) material that contains any virus, Trojan horse, worm or other programs that have an adverse effect on the SnapLoader Platform, the Hosted Environment, the internet or other persons’ systems, computers, devices, software or data; or
j) Material that disparages, makes fun of or satirises the SnapLoader, the SnapLoader Platform, the SnapLoader name, or any of SnapLoader’s products or services.You must not aid, abet, counsel or procure any of the above.
THINGS YOU MUST NOT DO
You must not use the SnapLoader Platform to, and you must ensure that no link connects to any Linked Content that is, in our opinion, used to:
a) store information related to, or display, market, sell or offer to sell, any product or service that is pornography, escort services, illegal goods including illegal drugs, substances and weapons and pirated computer programs, instructions on how to assemble or otherwise make bombs, grenades or other weapons, or any other products, services or content that it is unlawful to sell or offer to sell in Australia or any other country;
b) engage in any libellous, defamatory, scandalous, threatening or harassing activity;
c) breach the provisions of the SPAM Act 2003 (Cth);
d) broadcast unsolicited commercial messages, including emails that are sent to persons who you cannot demonstrate has positively consented to the receipt of that type of message;
e) collect or re-direct responses from unsolicited emails from accounts of other service providers;
f) provide misleading information as to the origin of a message, or alters headings, return email information and/or internet protocol addresses in order to conceal the origin of a message;
g) provide misleading information as to the identity or authority of the person making the posting;
h) distribute any virus, Trojan horse, worm or other programs that have an adverse effect on the SnapLoader Platform, the Hosted Environment, the internet or other persons’ systems, computers, devices, software or data;
i) hack or facilitate hacking; or
j) bring SnapLoader or any of SnapLoader’s products or services into disrepute.You must not aid, abet, counsel or procure any of the above.
IF YOU DO NOT COMPLY WITH THIS POLICY
SnapLoader does not actively monitor the SnapLoader Platform, the content that is loaded into it or any Linked Content, nor does SnapLoader exercise actively supervision over the SnapLoader Platform, the content that is loaded into it or any Linked Content, nor does SnapLoader monitor the SnapLoader Platform, the content that is loaded into it or any Linked Content to determine whether there has been any failure to comply with the Acceptable Use Policy.
If SnapLoader becomes aware of a breach, or threatened breach, of the Acceptable Use Policy, then, in addition to any remedy SnapLoader may have under any agreement with you, SnapLoader may take any action that it deems, in its unfettered discretion, prudent or necessary to prevent or remedy that breach, including immediately and without notice:
a) preventing access to any user or group of users, and/or
b) intercepting, removing or altering any content stored in the SnapLoader Platform or the Hosted Environment;
c) disconnect any link to any Linked Content.SOME TERMS WE USE IN THIS ACCEPTABLE USE POLICY
Hosted Environment means the hardware, software and network infrastructure owned or operated by, or under contract to, SnapLoader (excluding any network or infrastructure outside of SnapLoader’s firewall) on which the production version of the SnapLoader software operates.Linked Content means any material, information or data in any form, including websites, social media sites, text, image, sound or video and other data sources of any type to which a user is directed when the user operates any type of link from the SnapLoader app.
SnapLoader is the trading name of JacFink Pty Ltd ACN 145 942 650SnapLoader Platform means SnapLoader’s software that connects multiple publishers with multiple brands, and enables them to add the SnapLoader logo to their publications, marketing materials or promotional material.
